General Terms of Sale


• Prior recommendations

We recommend that you read the present general terms of sale which lays the contractual relationship between « Armagnac.com » and its customers.
We have selected with care all the products presented on our website. Quality and the prices are our only selection criteria. The possible comments about products come from producers and wholesalers.

• Prices and term of offer

Spirit products prices sold on Armagnac.com are those displayed on the website and duplicated on the order form. They are shown in euros (EUR) VAT included (rights and taxes in effect, French VAT of 19,6% included). The prices shown in the Armagnac.com catalogue do not include delivery fees or re-delivery fees (if no one is home when we attempt to deliver on the scheduled date and time, and you need to reschedule a date of delivery), These fees will be on the charge of the customer. The offer is valid from the moment it is published until its withdrawal.  The offer applies to the items defined by the Armagnac.com’s online catalogue. This offer applies to customers who are E.U residents. However, the commercial department of Armagnac.com will do everything its best to satisfy (in the limit of current legislation about spirits export) those who live in a country outside of the E.U. According to the country, custom duties may be charged upon claiming your order. These charges may vary from one country to another and cannot be defined in advance by Armagnac.com, nor does Armagnac.com claim responsibility.
The delivery of any order is only guaranteed depending on the limit of the open stock. In case of a product is out of stock from a producer or a wholesaler, Armagnac.com commits itself to let it appear on each product, and if necessary, to inform the customer by e-mail if the order has already been placed.
In obedience to the French law « n°80.335 of May, 12th 1980 » and the articles « 115 alinéa 2 » and 122 of the French Law « n° 85.98 of January, 25th 1985 », it is agreed that the products remain Armagnac.com’s property until the full payment of the invoice. Armagnac.com reserves the right to cancel any order from a customer in case of litigation with a previous order
Photos illustrating products are not contractual in any way. Armagnac.com can slightly modify a product and from then its graphic representation. This cannot affect the validity of the sale.

• Guarantees

Legal guarantee of product defects : In conformity with the article 1641 of the French Civil Code: ”Each saler has to abide by the guarantee of the product defects of the item which make it improper to the use to which it is destined, or diminish this use so much that the buyer would have not bought it, or would have bought it for a cheaper price, had they know of these defects”.
“Money back” Guarantee: We hope our products will give you full satisfaction. However in obedience to the article L.221-18 of the French Code of Consumption, you have fourteen open days from the delivery day to return the item for exchange or refund without any penalty other than the mailing price. The refund will follow within 30 days from the day of reception of the item by Armagnac.com
Force Majeure Clause: Total or partial strike, lockout, bad weather, epidemics, blocking of means of transportation or supply for any reason, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, modifications of laws or regulations concerning the means of commercialization, total or partial blocking of the means of telecommunication and communication, including networks and services, and their normal functioning. The Force Majeure Clause constitutes a cause for suspending or cancelling Armagnac.com’s obligations without compensation for the customer in case the event lasts longer than a month.

• Litigation and competent jurisdiction

Present sales conditions are submitted to the application of French law. The Court of the Head Office of ARMAGNAC.COM is the only competent to rule any litigation linked to the application of present general terms of sales.


• Legislation


All the products on sale on Armagnac.com respect the French legislation. The sale of spirits by Armagnac.com is strictly reserved to individuals considered of age by their national legislation (18 years old in France). However, if these items are bought from another country without respecting the law of the said country, Armagnac.com’s liability will not be upheld.
